Insparya is a Clinical Group exclusively dedicated to the Diagnosis, Treatment, and Research of Hair Health and Hair Transplantation, with facilities in Porto, Lisbon, Braga, Viseu, Vilamoura, Madrid, Barcelona, Bilbao, M\u00e1laga, Valencia, Milan, Rome, Muscat, and Riyadh.<\/p>

RESPONSIBLE FOR PROCESSING DATA<\/b><\/b><\/h3>

For the purposes of this Privacy Policy, the person responsible for processing personal data is Sa\u00fade Vi\u00e1vel S.A., (also referred to as \"Insparya\"), with its registered office at Avenida Montevideu n\u00ba 66, 4150-516 Porto and its web address: www.insparya.pt.<\/p>

LEGAL BASIS FOR PROCESSING DATA<\/b><\/b><\/h3>

Data protection is a particular priority for Insparya, which aims to protect the privacy of its Users.<\/p>

Insparya guarantees that all information of a personal nature is treated and protected with the utmost diligence and in accordance with EU Regulation 2016\/679 - General Data Protection Regulation (GDPR) and domestic legislation on the matter.<\/p>

Through this Privacy Policy, and under the Transparency Principle, you will obtain information on how Insparya collects, processes and uses Users' personal data collected in connection with the use of the website www.insparya.pt, the type of data it collects, the purposes for which it uses it, the methods of processing the data, as well as Users' rights in relation to such processing and how to exercise them.<\/p>

This Privacy Policy also applies to personal data provided by the Candidate when submitting their Curriculum Vitae (\"Cv\") and managing their application. Insparya protects the Candidate's privacy when they submit their CV spontaneously via the company's website or apply for a job offer as part of an ongoing recruitment process and ensures that the information collected is used exclusively for the purposes set out in this policy.<\/p>

4. PERSONAL DATA COLLECTED AND LEGAL GROUNDS FOR ITS<\/b><\/b><\/h3>

Insparya requests personal data in the following menus:<\/p>

a) Registration for Hair Assessment Consultation:<\/b><\/b><\/p>

To submit a request for a Hair Assessment Consultation on the Insparya website, you must fill in the form, which asks for some personal details, such as your name, telephone number and e-mail address. Reading and expressly accepting the Legal Conditions and Privacy and Cookies Policy is a mandatory requirement for completing your registration.<\/p>

b) Registration for Online Hair Assessment, Diagnosis and Treatment Proposal:<\/b><\/b><\/p>

If you would like an online hair assessment, you will be asked for the following information: name, age, location, telephone number, email address, best time to contact you, how you found out about Insparya, the type of transplant you are looking for (hair, eyebrows, beard), gender (male, female), when the hair loss started, if you have a family history of baldness, if you have already undergone a transplant to treat alopecia, the degree of baldness and photographic records (optional).<\/p>

This data will be processed and analysed by our Clinical Team, after which we will respond as soon as possible. If the information provided is insufficient, the User also gives their consent for their contact details to be used to clarify what is appropriate to fulfil the request, in particular by suggesting the scheduling of a face-to-face consultation so that we can carry out the Diagnosis, Treatment Proposal and clinical recommendation that we consider most appropriate to the needs of the specific case.<\/p>

By submitting their request for an Online Hair Assessment, the User gives their express, free and informed consent for their personal data to be collected and processed for the purposes and under the terms and conditions mentioned above, further stating that all the information provided does not contain any omissions and corresponds to the truth.<\/p>

Receipt of the photographic records, which are optional, demonstrates and confirms the User's consent to the use of the material sent for the intended purposes by the clinical team, which is under the clinical coordination of Dr Carlos Portinha.<\/p>

c) Submit an application:<\/b><\/b><\/p>

When submitting an application you will also be asked for some personal details (name, age, country, telephone number, city, email address, profession and academic qualifications), which are collected in specific form fields and are not accessible to other users of the Insparya website.<\/p>

Processing can also be carried out electronically, namely if an applicant sends the corresponding application documents by e-mail or via a form on the website.<\/p>

As your data will be used to assess your application, you are advised to check the references and other information you have provided. Insparya will use the data to respond to your application and call you in for an interview if your profile fits a position for which there is a vacancy.<\/p>

Your CV will be stored in Insparya's database and will be accessible by our recruitment consultants.<\/p>

The categories of recipients of the Applicant's personal data are the Human Resources department and the Team Leader of the function or area that is being applied for.<\/p>

The recruitment process does not involve automated decision-making, including profiling.<\/p>

Candidates can update their CV at any time, simply by following the same procedure as for sending a new CV. Their old CV will automatically be replaced by the new one.<\/p>

d) Submit a Suggestion, Complaint or Question:<\/b><\/b><\/p>

When you fill in the form with your suggestion\/complaint\/question you will be asked for some personal details such as your full name, e-mail address, telephone contact and message. This data is collected in specific fields on the form and is processed by Insparya. The purpose of collecting this data is to enable Insparya to correctly identify the organisation concerned, the situation reported and to make direct contact with the owner of the suggestion\/complaint. With the exception of the organisation concerned, Insparya will not transfer your data to third parties for any purpose.<\/p>

e) Submit an application to become a possible Insparya Partner or Ambassador:<\/b><\/b><\/p>

When you submit an application to join the Network of Partners or Ambassadors, you will be asked for some personal data, namely: name, email, mobile phone, location, profession and contact hours, which are collected in specific form fields and are not accessible to other users of the Insparya website.<\/p>

Users give their express, free and informed consent for their personal data to be collected and processed for the aforementioned purposes. Reading and expressly accepting the Legal Conditions and Privacy and Cookies Policy is a mandatory requirement for completing your registration.<\/p>

f) Membership of the \"Insparya PRO\u201d application:<\/b><\/b><\/p>

Signing up to the \"Insparya PRO\" App implies registering the Partner's personal data, as well as that of customers referred by the Partner, namely name, telephone number and email address.<\/p>

The personal data of clients referred by the Partner will only be processed by Insparya once the client has declared that they accept Insparya's processing of the data for the purpose of contacting them to book a free face-to-face hair assessment at Insparya's premises.<\/p>

g) Submit a request for assessment to the Customer Ombudsman:<\/b><\/b><\/p>

When you submit a request for assessment to the Customer Ombudsman's Office, you will be asked to provide certain personal data collected through the form, which will be processed by the Customer Ombudsman's Office for the purpose of analysing and responding to the complaint submitted, the basis of which is the authorisation of the respective owner when they address the matter to the Customer Ombudsman's Office, requesting that it be examined. This processing will always be carried out in compliance with the applicable legislation.<\/p>

4.1 HOW IS PERSONAL DATA COLLECTED<\/b><\/b><\/p>

Some of Insparya's services do not require any form of registration, and data subjects can visit the company's website without having to identify themselves.<\/p>

However, there are other services and functionalities that necessarily require the provision of personal data.<\/p>

The online hair assessment request form available on the Insparya website has mandatory fields (labelled *) and optional fields. Failure to provide the mandatory information means that the online hair assessment request cannot be submitted.<\/p>

Insparya will only use personal data when it has been voluntarily provided by its owners, for the purposes for which it was provided and always with their consent.<\/p>

Insparya pays special attention to the protection of the rights of minors, which is why the collection of personal data from minors under the age of 16 is dependent on the consent of their parents\/guardians. In the event of any collection of data from minors, the e-mail address of the parents\/guardians will be requested for written confirmation that they consent to the processing of personal data of the minors in question, if applicable.<\/p>

4.2 PURPOSES FOR COLLECTING DATA<\/b><\/b><\/p>

a) Candidates:<\/b><\/b><\/p>

To enable Candidates to submit their CVs as part of spontaneous applications, to apply for specific jobs or to subscribe to Insparya's job alerts, with the company processing the necessary data for the purposes of recruitment, selection and direct contact with the candidate.<\/p>

To this end, Insparya requests and collects the following personal data when you apply: name, e-mail address, mobile phone, address, town, postcode, date of birth, nationality and gender. Some of these details, which are indicated on the forms on the website, must be provided, otherwise it will not be possible to complete the application process.<\/p>

To complete the application, candidates are also asked to upload their CV.<\/p>

The data provided by the Candidate will be kept for a period of 6 months, after which it will be deleted or until the data subject exercises their right to cancellation. After this period, if the Candidate wishes to continue to be included in the Insparya Clinical Group's recruitment database, he\/she must submit a new application.<\/p>

b) Customers and third parties:<\/b><\/b><\/p>

Insparya holds, uses and discloses the User's personal data among the various entities of the Insparya Clinical Group for its legitimate purposes, including:<\/p>

- Fulfilment of contractual obligations;<\/p>

- Informing Users of new services made available;<\/p>

- Improving and personalising the service provided to the User (answering questions posed by the User, processing requests for information and any complaints);<\/p>

- Occasionally, for marketing and communication purposes, such as, in general, offers, special campaigns and up-to-date information on Insparya's activity.<\/p>

c) Marketing:<\/b><\/b><\/p>

Insparya will only use contact details (name, email address, telephone number) for direct and indirect marketing actions, which consist of manually or automatically sending newsletters or personalised contacts about news, hair products, campaigns, promotions or other information, if this option has been explicitly authorised by the User. may revoke this consent at any time by contacting Insparya directly via the DPO ( dpo@insparya.pt).<\/p>

You can unsubscribe from our newsletter at any time by clicking \u201cUnsubscribe\u201d in the email communication or by contacting Insparya directly through the DPO (dpo@insparya.pt).<\/p>

Insparya will use the data provided to carry out market research, clinical and scientific studies, quality assessment and satisfaction surveys and statistical analyses, if expressly authorised by the User.<\/p>

c.1) Profiling:<\/p>

Insparya carries out profiling based on the information collected from visits to the website and the consumption habits of its customers.<\/p>

This information allows Insparya to send personalised information about news, campaigns or promotions appropriate to each profile.<\/p>

Insparya uses statistical information related to its Patient profiles to improve its offer, plan its communication, manage campaigns and promotions.<\/p>

d) Photographs and patient testimonies:<\/b><\/b><\/p>

Insparya may publish testimonials \/ comments \/ photos \/ videos and references from Patients on its website for the purpose of promoting and publicising its treatments and products.<\/p>

Before publishing these images \/ testimonials, Insparya ensures that it has obtained the express written consent of the data subject and guarantees that the dissemination of these testimonials \/ images will not be used for purposes other than those mentioned, unless the data subject is notified and gives their consent.<\/p>

e) Sharing personal data:<\/b><\/b><\/p>

In certain circumstances Insparya may transmit the User's personal data to third parties, provided that for this purpose i) it has unequivocally obtained the User's consent; ii) when the transmission is made in the context of the fulfilment of a legal obligation, a court order or a decision by the National Data Protection Commission; or iii) to respond to requests from public or government authorities.<\/p>

Personal data may be transmitted and related between the various entities of the Insparya Clinical Group and its Employees.<\/p>

Insparya will also share personal information with third parties who perform functions on behalf of Insparya and provide services to the company, such as:<\/p>

- Professional consultants;<\/p>

- Data analysis providers;<\/p>

- Function coordinators.<\/p>

- IT and website management and hosting companies<\/p>

Insparya may transmit and receive your data to\/from subcontractors for the purposes mentioned above, under the terms of the contracts signed with them. Only the personal data necessary for the provision of the service in question is provided to these companies, and these entities undertake to process said personal data solely and exclusively for the fulfilment of the purposes indicated and under the duty of confidentiality.<\/p>

Insparya may also share your data with third parties who manage digital platforms for the purposes of marketing campaigns.<\/p>

Insparya will not sell to third parties the personal data that the data subject provides in the consultation request process, online hair assessment consultation request or in the application submission form.<\/p>

Insparya will process user data within the territory of the European Economic Area (EEA) and therefore does not plan to carry out any international transfer of data.<\/p>

f) \u00abInsparya PRO\u00bb application:<\/b><\/b><\/p>

As part of joining and using the \"Insparya PRO\" application, the Partner's personal data will be collected for the following purposes: a) identification data that enables the creation and management of the Partner's personal account, as well as, in the event of loss, theft or misplacement, recovering the benefits already accrued; b) data on transactions made (such as amount, anonymised Client identification and services purchased); c) location data, on the basis of which Insparya will be able to present personalised promotions closer to the Partners and; d) identification data for access to the \"Insparya PRO\" Points System Programme.<\/p>

Insparya uses the personal data of clients referred by the Partner exclusively for the following purposes: to contact and inform clients recommended by the Partner of the possibility of a free hair assessment at \"Insparya Clinics\", as well as to promote, publicise and recommend other services provided by Insparya. This data may also be stored and processed, for a period of 2 years, with the aim of personalising the services provided to clients recommended by the Partner and, possibly, for marketing and communication purposes, such as, in general, offers, special campaigns and up-to-date information about Insparya.<\/p>

5. RIGHTS OF THE DATA SUBJECT:<\/b><\/b><\/h3>

Users have certain rights in relation to the personal information that Insparya holds about them. The details of these rights and how to exercise them are set out below. However, Insparya will need proof of your identity before it can act on your request.<\/p>

For as long as Insparya holds or processes personal data, Users may, at any time and free of charge, exercise the following rights:<\/p>

a) Access: the right to, at any time, request from Insparya a copy of the personal information that the Company holds about you.<\/p>

b)<\/b> b) Correction or Completion: the right to correct data that you consider to be inaccurate, incomplete or out of date;<\/p>

c) Right to Erasure: the right to request the erasure of data that Insparya holds about you, e.g. if the information is no longer necessary for the purposes for which it was collected or processed. This right is without prejudice to Insparya's fulfilment of its legal obligations to retain personal data;<\/p>

Although Insparya will make every effort to carry out the measures deemed appropriate to fulfil the deletion request, the total deletion of the record from the systems can take up to a maximum of 30 days.<\/p>

d) Right to restrict data processing: in certain circumstances, you have the right to object to the processing of your personal information and\/or the use of your personal information for direct marketing purposes.<\/p>

e)<\/b> e) Opposition to automated processing, including profiling;<\/p>

f) Data Portability: the right, under certain circumstances, to receive any personal information that the Company holds about you in a structured, commonly used and readable format, and to request that Insparya transmit this information to you or to a third party company.<\/p>

g)<\/b> g) Withdraw Consent: insofar as Insparya is processing the User's personal information on the basis of their consent, the User has the right to withdraw their consent at any time.<\/p>

However, this right does not compromise the lawfulness of the processing carried out on the basis of the consent previously given, nor the subsequent processing of the data on another lawful basis, such as the fulfilment of a contract or a legal obligation to which Insparya is subject.<\/p>

If the User wishes to exercise any of the above rights or withdraw their consent, they may do so by contacting us:<\/p>

(i)<\/b> (i) in person at the Insparya Clinical Group Units,<\/p>

(ii) with the Insparya Group Data Protection Officer via the following contact: . dpo@insparya.pt<\/p>

In the case of data relating to your health, the right of access to health information by the data subject (or third parties with their consent or in accordance with the law) can be exercised directly, or through a doctor if the data subject so requests, by means of a written request addressed to dpo@insparya.pt .<\/p>

If Insparya is subject to limitations and exceptions, it will give reasons why it is not possible to fulfil the request for the exercise of the User's rights.<\/p>

6. RETENTION PERIOD FOR DATA<\/b><\/b><\/h3>

Without prejudice to other time limits provided for in the legislation in force, namely in tax, accounting, labour and contractual liability matters, personal data will be kept for the minimum period of time necessary and proportionate for the pursuit of the purposes for which the personal data was collected.<\/p>

For the purposes described in this Privacy Policy (with the exception of the fulfilment of legal obligations, the retention period of which will depend on the applicable legal deadlines), personal data will be kept for a maximum period of 10 years from the collection of your consent or the last registration made and if, within this period, you have not withdrawn your consent.<\/p>

With regard to recruitment processes, should Insparya formalise an employment contract with a candidate, the data sent will be stored for the purpose of processing the employment relationship in accordance with legal requirements.<\/p>

If no employment contract is concluded, the Candidate's personal data is kept for 6 months after which it is automatically deleted, provided that no other legitimate interest of Insparya opposes deletion.<\/p>

Alternatively, the data may be anonymised in such a way that the Candidate is not or can no longer be identified.<\/p>

7. SUBCONTRACTING<\/b><\/b><\/h3>

Insparya has defined clear rules for contracting the processing of personal data with its subcontractors and requires them to adopt the appropriate technical and organisational measures to protect the personal data of its Users.<\/p>

Insparya may communicate Users' personal data to subcontractors, and will always be responsible for processing it, provided there is prior unequivocal authorisation from the data subject. This is the case with organisations that provide support services for the company's IT systems, clinical service providers, consultancy firms and law firms.<\/p>

Any subcontractor of Insparya will process the personal data of Insparya's Patients in the name and on behalf of Insparya, under the strict obligation to follow its instructions, which must always be given in writing, in compliance with the GDPR, in particular the provisions of art. 28, no. 3 al. a) of the GDPR.<\/p>

All entities subcontracted by Insparya will be bound to it through a written contract which regulates, in particular, the object and duration of the processing, its nature and purpose, the type of personal data, the categories of data subjects and the rights and obligations of the parties.<\/p>

Insparya ensures that the processors provide sufficient guarantees for the implementation of appropriate technical and organisational measures so that the processing meets the requirements of the applicable law and ensures the security and protection of the rights of the data subjects, under the terms of the processing agreement signed with the said processors.<\/p>

8. SECURITY MEASURES<\/b><\/b><\/h3>

Insparya undertakes to take all measures and implement appropriate technical and organisational measures to ensure an adequate level of security to protect Users' Personal Data and other information, in particular against its destruction (accidental or unlawful), loss, alteration, dissemination, manipulation or unauthorised access and against any form of unlawful processing, and continuously adapts its security measures in accordance with ongoing technical developments.<\/p>

Insparya ensures technological and organisational security measures for the protection and confidentiality of the data collected through its website, having approved and implemented strict rules in this regard. Compliance with these rules is an unavoidable obligation of all those who legally access them.<\/p>

On the Insparya website, the personal data collection forms require encrypted browser sessions and all the personal data that the User provides about themselves is stored securely in Insparya's systems.<\/p>

However, since it is impossible to guarantee the absolute security of any information sent over the Internet (open network), there is a risk of data being accessed by unauthorised third parties. However, even in these circumstances, Insparya continuously adopts and develops security mechanisms to protect the personal data collected.<\/p>

In the event of a breach of security leading to the accidental or unlawful deletion, loss, modification, dissemination or unauthorised access of personal data, Insparya undertakes to notify the CNPD of the occurrence, whenever possible, within 72 hours of becoming aware of it and without undue delay, as well as the respective data subject.<\/p>

All the personal data already indicated, whether information entered by the User, automatic information, email and other interactions with the Insparya website are stored in a secure Database, accessible only to duly authorised and accredited Insparya Employees and subcontractors provided they are duly authorised, accredited and identified.<\/p>

All data is backed up regularly to prevent data loss, encrypted and kept in a secure place inaccessible to unauthorised persons.<\/p>

Only duly authorised and accredited Insparya employees can access, enter and manipulate Users' personal data, and only if strictly necessary. This access is always carried out through platforms with access control and registration. In the case of physical (paper) records, when they exist and are stored, they are archived in a place with restricted access.<\/p>

So that this process is imbued with a higher level of security and accuracy, the data collected on our website is directly integrated into software belonging exclusively to Insparya<\/p>

Insparya also records a complete audit that identifies which user, day and time, accessed each piece of personal data.<\/p>

Insparya has drawn up and publicised personal data protection procedures for all its employees, with a view to ensuring that they are aware of the obligations imposed on them in this area, and has organised training sessions for them, who undertake not to disclose to third parties or use for purposes contrary to the law any personal information about Insparya's patients that they become aware of in the course of carrying out their duties.<\/p>

Insparya has also appointed a Data Protection Officer (\"DPO\") to monitor compliance with the applicable policies and regulations on the protection of personal data. As described in this Privacy Policy.<\/p>

9. SURVEILLANCE<\/b><\/b><\/h3>

The Insparya Clinics have a video surveillance system, duly signposted, and the installation of the system is a security measure.<\/p>

Image recordings obtained by video surveillance systems are kept in an encrypted record for a period of 30 days from the time they were taken, after which they are destroyed (without prejudice to retention for a longer period in the event of legal proceedings).<\/p>

We do not collect sound. Access to images is not permitted, except at the request of a court.<\/p>

At Insparya Clinics, there are notices warning of the existence of video surveillance, with the words \"For your protection, this location is subject to video surveillance\".<\/p>

10. AUTHORITY<\/b><\/b><\/h3>

The competent authority in terms of the General Data Protection Regulation (GDPR) and internal legislation on the matter is the National Data Protection Commission (CNPD), with address at - Av. D. Insparya will co-operate with the Supervisory Authority by providing it with all the information it requests in the exercise of its powers.<\/p>

The Data Subject can always contact the DPO if they wish to exercise their rights or receive any clarification. However, you should bear in mind that in certain cases, under the terms of the applicable law, your request may not be immediately or fully satisfied. However, you will always be informed of the measures taken to this end within one month of the request being made.<\/p>

Insparya may, at any time and without prior notice, amend these terms and conditions, which will be published on the Insparya websites.<\/p>

14. CHANGES TO 'S PRIVACY POLICY<\/b><\/b><\/h3>
