Premise

These general terms and conditions of sale are agreed between Saúde Viável, S.A., with registered office at Avenida Montevideu, no. 66, 4150-516 Porto, tax identification number 508 907 713, hereinafter referred to as “Insparya”, and the persons who wish to make purchases through the website www.insparya.store , hereinafter referred to as the “User”.

The parties agree that purchases made through the website www.insparya.store shall be governed exclusively by this agreement, excluding any conditions previously available on the website.

Article 1 – Subject

1. These general terms and conditions of sale aim to provide and define all necessary information to the User regarding the procedures for ordering, sale, payment, and delivery of purchases made on the website www.insparya.store . www.insparya.store.

2. These conditions govern all steps required to place an order and ensure its tracking between the Contracting Parties.

Article 2 – Order

The User places an order by completing the purchase process presented on the website www.insparya.store , adding the desired product(s) to the shopping cart.

2. To submit the order, the User must:

1. Register on the website www.insparya.store by providing the requested information;
2. Log in (using the email and password combination chosen during registration);
3. Complete the required information and select the available options during the checkout process (delivery and billing address, shipping method, payment method, as well as the tax identification number and name to be indicated on the invoice for tax purposes).

3. The User’s final confirmation of the order constitutes full and complete acceptance of the prices and product descriptions available for sale, as well as these General Terms and Conditions of Sale.

4. Insparya will fulfill online orders only up to the available stock. In the event of product unavailability, Insparya undertakes to inform the User as soon as possible.

5. The information provided on the invoice is the sole responsibility of the User. Once issued, the invoice cannot be modified.

Article 3 – Payment

On the website www.insparya.store, Insparya offers the User the following payment methods, managed through Easypay — Instituição de Pagamento, Lda:

• Credit/debit card (Visa, Mastercard);
• Apple Pay;
• Google Pay;
• MB Way;
• Multibanco Reference. 

2. In the case of payment by credit or debit card, the charge will be applied to the User’s card immediately after the confirmation of the shipment of the goods. If a requested product is out of stock, the corresponding amount will be refunded to the User’s card after the order is closed.

Article 4 – Delivery

1. Orders will be delivered within the following timeframes, after payment confirmation:

• Mainland Portugal and islands: within 2 business days;
• Spain: within 3 business days;
• Italy: within 5 business days.

Shipments are made to Portugal, Spain, and Italy. For other destinations, the User may express their interest by email at store@insparya.com .

3. Shipping is handled by CTT – Correios de Portugal, S.A., with a delivery fee of €6.00 (six euros), regardless of the destination or order value, for all available markets: Portugal, Spain, and Italy.

4. After dispatch, the User will receive an email with the tracking number. If this notification is not received, they should contact Insparya via email at store@insparya.com. store@insparya.com.

Article 5 – Prices

1. Prices are expressed in euros (€), including taxes, based on the VAT applicable on the date of payment of the order.

2. In the event of a change in the price of a product, the User will be informed immediately and may choose either to maintain the order (by paying the difference) or to cancel it.

Article 6 – Cancellation and Returns

In accordance with Decree-Law No. 24/2014, of February 14, the User has the right to withdraw from the distance contract within 14 (fourteen) days from the date of receipt of the order, without having to provide a reason. Insparya extends this period to 30 (thirty) days from the date of receipt.

The cancellation or return process will be handled on a case-by-case basis by Insparya. The request must be submitted in writing to the email address store@insparya.com , indicating the order number; instructions will be provided by Insparya via the same channel.

3. For a return to be accepted, the product must:

• Be sealed and unused;
• Be in its original packaging;
• Be accompanied by proof of purchase.

Returns of products purchased under promotion or discount are accepted, provided the above conditions are met.

4. The User can return the product in two ways:

• In-person delivery (free of charge): at the nearest Insparya clinic; na clínica Insparya mais próxima;
• Postal shipment (at the User’s expense): to Insparya Science and Clinical Institute, Rua Marechal Saldanha, no. 1354, 4150-650 Porto. para Insparya Science and Clinical Institute, Rua Marechal Saldanha, n.º 1354, 4150-650 Porto.

5. Whenever possible, refunds will be made using the same payment method used for the purchase. Otherwise, the User must provide proof of payment and account or card ownership so that the refund can be processed via bank transfer. 

Exchanges are made only in the case of defective or damaged products. The User must contact Insparya as soon as possible at store@insparya.com .

Article 7 – Privacy Policy

The processing of personal data is carried out in accordance with the applicable data protection legislation, in particular Regulation (EU) 2016/679 (GDPR). The data, subject to electronic processing, will be incorporated into the database of Saúde Viável, S.A. and will be used for order registration and management, as well as for the presentation of other products and services, including institutional information.

Providing personal data is voluntary, and the User is guaranteed, under the legal terms, the right to access, rectify, erase, and port any personal data concerning them. These rights can be exercised via email at store@insparya.com or at the registered office of Insparya.
